From the 7th Circuit U.S. Appeals Court in Chicago, an important ruling in the case Freedom From Religion Foundation v. Elaine Chao, et al. will allow taxpayers to challenge executive-directed programs — in this case, namely Bush’s Faith-Based Initiative — and will reinstate the Foundation’s lawsuit protesting the White House’s creation of faith-based initiative offices as an unconstitutional use of taxes to promote religion. The Foundation’s suit was originally filed last June, but thrown out in November on the order of a judge who ruled that the foundation had no standing to sue over an executive branch order. The reversal was based on three cases of taxpayers challenging federal assistance to religious entities.
