Student Disciplinary Process for NYU Prague

Policies and guidelines applicable to student conduct are generally the same as those you are used to at NYU and can be found at www.nyu.edu


General Policy Regarding Student Discipline

NYU believes that many conflicts can be resolved when individuals are brought together to seek solutions to differences through open and honest communication. NYU Prague will not tolerate failure to comply with NYU or NYU Prague policies, which have been created to serve the entire student body and the wider community of which NYU Prague is a part.


Outline: the NYU Disciplinary Process

Should the administration be concerned that any NYU Prague student may have breached policies or expected standards of behavior (as set out in the Study Abroad Standard and in the NYU Student’s Guide); the matter will be investigated thoroughly. NYU Prague staff can make use of a broad range of
disciplinary measures if required.

Stage 1: Investigation of Student Misconduct

Assistant Director for Student Life/Building Manager/RA will very quickly make contact and meet with witnesses or any individuals who may have been involved in any alleged misconduct, and gather as much pertinent information as possible. Once relevant information has been obtained, this will be reviewed. Should the Associate Director or Director believe there is sufficient evidence to consider the possibility of disciplinary action, the investigation will proceed to stages 2 or 3, depending upon the severity of the case.

Stage 2: Disciplinary Meetings

In cases where the alleged offences are of a relatively minor level, the student (s) involved will be called in to meet with the Assistant Director for Student Life immediately to discuss the behavior in question and to attempt to facilitate a prompt and amicable resolution of the issue. In general, failure to comply with NYU Prague rules and policies will lead to a Disciplinary Meeting.

Examples include:

  • disorderly, disruptive, or aggressive behavior that interferes with the general comfort, safety, security, health or welfare of the residence hall community, and/or the regular operation of the University.
  • noise violations – making excessive noise after midnight in halls; failure to cease disruptive behavior when asked to do so
  • vandalism or damage to University or personal property, including tampering with safety equipment such as fire extinguishers and fire / smoke alarms
  • smoking in NYU Prague apartments or buildings

After reviewing the evidence and discussing the matter with the students concerned, there are a range of  options should the Assistant Director for Student Life conclude that disciplinary action is warranted.

These include:

  • issuing formal written warnings to students regarding the continuation or repetition of misconduct (incorporating the creation of a ‘Future Conduct Agreement’)
  • placing students on disciplinary probation
  • placing students on housing probation
  • deduction of NYU housing points
  • student to make restitution to the University
  • counseling and/or mandatory evaluation
  • health referral
  • room / hall reassignment

Stage 3: Formal Disciplinary Hearings with NYU Prague Director

When an alleged violation is viewed as serious and possibly warranting more severe disciplinary action than those outlined in Stage 2 of the disciplinary process, the Assistant Director for Student Life, upon written notice to the student, may refer the matter to NYU Prague Director.

Examples of behavior which will lead to a Formal Disciplinary Hearing:

  • persistent failure to observe NYU Prague policies.
  • harassment or abusive behavior toward another individual by any means for any reason.
  • physical violence, actual or threatened, against any individual or group of persons.
  • engaging in, or threatening to engage in, any other behavior that endangers the health or safety of another person or oneself.
  • failure to observe Future Conduct Agreements drawn up by the Assistant Director for Student Life.
  • use of non-prescription drugs, such as marijuana.

The Director will meet promptly and review the matter according to such procedure as the members deem appropriate. If the Director concludes that a sanction is warranted, a recommended sanction may include:

  • probation
  • restitution, and/or community service
  • emergency temporary suspension from housing
  • full suspension from housing
  • dismissal from housing
  • suspension from the program

The Director shall decide whether a sanction is warranted and, if so, approve the appropriate sanction.
When the Director determines that the sanction of suspension is warranted, the Director shall consult with the Dean of the School in which the student is enrolled at the University before imposing such sanctions. In the event that the student is from an institution other than NYU, the Director shall consult with the designated representative from the Office of the Vice Provost before imposing such sanctions and may then notify the college or university in which the student is permanently enrolled of the student’s suspension from the program. Students are entitled to appeal against the findings of Formal Disciplinary Hearings.

Stage 4: Immediate Suspension from the Program

If in the opinion of the Director, a student’s behavior presents an imminent threat to his or her own physical or emotional health, safety or well-being, or the health, safety or well-being of others, or threatens University property, the maintenance of public order, or the effective continuation of the educational-
process, the Director may immediately suspend the student from the program prior to any formal disciplinary proceeding and shall promptly advise the Dean of the School in which the student is enrolled, or the designated representative from the Office of the Vice Provost, who may notify the college or university in which the visiting student is permanently enrolled.
